To support families, the government has announced the creation of a new birth leave, a significant reform of the current parental leave system. The objective is to allow parents to spend more time with their child while benefiting from a higher level of compensation.

    To support families, the government has announced the creation of new birth leave, a major reform of the current parental leave system. The aim is to allow parents to spend more time with their child while benefiting from a higher level of compensation.

    Effective date, leave duration, benefit amounts, procedures to follow with your employer or Social Security... Here is all the essential information to understand this new right and serenely prepare for your baby's arrival.

    What is the new birth leave that replaces parental leave?

    The new birth leave is a measure provided by law to reform the current parental leave for education. Until now, parents could interrupt or reduce their professional activity to care for their child while receiving PreParE, a benefit paid by the CAF.

    However, this system has several limitations: the duration can be long, but the level of compensation remains relatively low. In practice, many parents forgo this leave because the loss of salary is too significant.

    The reform therefore proposes a new system:

    The objective is to encourage a better distribution of parental responsibilities and to allow families to fully enjoy the first few weeks of their child's life.

    This evolution is part of a broader family policy aimed at supporting maternity, paternity, and parenthood. It also aims to encourage companies to better consider the balance between professional and family life.

    Unlike the old parental leave, often taken by only one parent (most often the mother), this new arrangement encourages both parents to actively participate in the child's first months of life.

    Who can benefit from it and from when?

    The new birth leave is expected to come into effect on July 1, 2026, according to government announcements and the first elements published by public bodies.

    This measure will concern several situations:

      • birth of a child
      • adoption
      • arrival of a child in the household

    The scheme should be accessible to different professional profiles:

      • private sector employees
      • civil servants
      • self-employed workers
      • certain part-time workers

    To benefit from this leave, certain conditions must be met. The parent must notably:

      • be affiliated with Health Insurance
      • justify recent professional activity
      • comply with administrative procedures with their employer

    The procedures can be carried out with different organizations:

      • the CPAM
      • the CAF
      • the Social Security
      • the Ameli platform

    The exact terms will depend on the implementing decrees published by the government. Parents can consult official information on sites like Service-Public.fr or Ameli.fr to learn about the specific conditions.

    An important point concerns children born from January 1, 2026, who could be affected by certain transitional provisions according to the modalities provided by law.

    Duration and compensation: how much will you receive?

    One of the main developments of this reform concerns the compensation for leave after birth.

    The new scheme provides that each parent can benefit from two additional months of leave to care for their child.

    Unlike the old parental leave, financial compensation will be higher to limit the impact on parents' salaries.

    The compensation principle would work as follows:

      • 1st month: 70% of net salary
      • 2nd month: 60% of net salary

    These indemnities will be paid by Health Insurance, via the CPAM, within the limit of the Social Security ceiling.

    This new level of benefits aims to make this leave more financially accessible for families.

    In the current system, many parents have to return to work quickly due to insufficient resources. With this reform, the goal is to allow parents to stay with their child during a crucial period for their development.

    These first few months are indeed crucial for establishing the attachment bond between parent and child.

    How to organize: notice periods and staggering

    To benefit from the new birth leave, certain procedures must be carried out with the employer.

    The parent must inform their employer by observing a notice period of at least one month before the start of the leave. This procedure allows the company to anticipate the employee's absence and organize work continuity.

    According to the terms provided by the decrees, several options should be offered to parents:

      • take the leave all at once
      • divide it into several periods
      • use it alternately between both parents
      • take the leave simultaneously

    This flexibility allows families to adapt the organization to their personal situation.

    For example, some parents might choose to take this leave right after maternity leave, while the other parent might take it a few weeks later. This arrangement sometimes allows for delaying the implementation of childcare.

    The leave could also be combined with other birth-related leaves, such as:

      • maternity leave
      • paternity leave
      • certain existing parental leaves

    The precise terms will be detailed by Social Security organizations and administrative information platforms.

    During these first few weeks, it is important to take care of your physical and mental health. The body needs time to recover from pregnancy and childbirth. Living your pregnancy well is important, but living your postpartum well is too! That's why it's important to prepare your postpartum.

    The new birth leave can offer precious space to slow down and gradually adapt to this new life as a parent.

    A few simple habits can help make this period more serene:

      • establish skin-to-skin moments with the baby
      • rest as much as possible
      • accept help from your loved ones
      • take a few minutes for yourself each day

    Some moms also like to create a small postpartum self-care ritual. A gentle massage of the belly or scar can help reconnect with one's body after childbirth.

    Taking a few minutes to apply a nourishing treatment, such as a stretch mark cream, a pregnancy stretch mark oil, or a postpartum balm, can become a welcome moment of pause in a day dictated by the baby's needs.

    These simple gestures contribute to self-care while building a new family routine.

    Le congé de naissance est-il obligatoire ?

    Non. Le nouveau congé de naissance est un droit supplémentaire prévu par la loi, mais il n’est pas obligatoire. Chaque parent peut choisir d’en bénéficier ou non selon sa situation professionnelle.

    Peut-on cumuler le congé de naissance avec le congé maternité ?

    Le deuxième parent peut-il le prendre en même temps ?
